Background
Mr. Phillips’ practice focuses on insurance coverage law and the litigation of construction defect matters, bad faith claims, commercial disputes, and the defense of personal injury claims. His coverage practice encompasses broad commercial liability issues as well as personal liability claims in both pre-litigation and litigated contexts. He provides exemplary counsel in a wide array of coverage matters, ranging from more proverbial issues such as construction defect claims, premises liability incidents, and uninsured motorist suits, to claims involving issues as varied as fraud, equestrian sports, and satellite piracy.
Throughout Mr. Phillips’ litigation practice, he has had the opportunity to first and second chair trials, obtaining exemplary results by trying cases in both civil courts and arbitration venues.
As a young attorney, Mr. Phillips worked as in-house counsel for an international franchisor, where he created and oversaw trademark licensing policy, resolved hundreds of intellectual property infringements, negotiated large services contracts, and prepared correspondence and legal memoranda for the company’s general counsel, CEO, and president. Before obtaining his law degree, he ran a successful seven-figure business in Illinois, giving him unique insights into the needs of his business clients during the litigation process and a practical understanding of how to mitigate the impact that lawsuits have on a company’s day-to-day business. Mr. Phillips previously spent a substantial amount of time working in the Middle East, where he has traveled extensively. He enjoys working with clients from varying backgrounds and helping them advance their goals despite the challenges that litigation can present.
Mr. Phillips' Legal Experience includes:
- Spearheading a team that obtained a walk-away settlement in a long-running $6.5M bad faith lawsuit in the state jurisdiction least hospitable to his client.
- Winning a full defense award including attorney fees in an arbitration for a “mom and pop” trade contractor embroiled in a seven-figure dispute with a national builder, despite the severe disadvantage of having to try the case under Colorado’s reduced burden of proof in the Burlington Northern Rule.
- Obtaining summary judgment for a national client in a $2.1M federal bad faith case.
- First-chairing the successful trial defense of a small business client in a highly contentious construction defect case.
- As a law student, represented indigent clients in domestic violence and family law cases, including the successful appeal of a trial court’s custody and parenting time order, winning an unusual full reversal with orders, allowing his client to avoid further remanded proceedings despite every precedent case having been returned to a district court for further hearings.
